These Terms and Conditions (“Terms”) govern your access to and use of the website located at https://groundupfoundationrepair.com and your engagement of services provided by Ground Up Builders, Inc., doing business as Ground Up Foundation Repair, Waterproofing and Concrete Leveling (“Ground Up,” “Company,” “we,” “us,” or “our”). By using our website or requesting our services, you agree to these Terms.
1. Services
Ground Up Foundation Repair provides residential and commercial foundation repair, basement waterproofing, crawl space repair, crawl space encapsulation, concrete leveling, and related structural services in Middle Tennessee and surrounding areas. All services are subject to a written proposal or contract that supersedes any oral representations.
2. Free Inspections and Estimates
We offer free, no-obligation inspections and written estimates for qualified residential properties. Requesting an inspection does not obligate you to purchase any service. Commercial inspections, geotechnical consulting, or unusually complex residential evaluations may be subject to a fee, which will be disclosed in advance.
Estimates are based on conditions observed at the time of inspection. If conditions change or additional issues are discovered during the work, we will notify you before proceeding with any scope or cost changes.
3. Contracts and Proposals
All services are performed under a written proposal or service agreement that describes the scope of work, pricing, payment terms, and applicable warranties. You should review all documents carefully before signing. Changes to the scope of work must be documented in a written change order signed by both parties.
4. Payment Terms
Payment terms are set forth in your signed service agreement. In general:
- A deposit may be required at the time of contract signing.
- The remaining balance is typically due upon substantial completion of the work, unless otherwise agreed in writing.
- Accepted payment methods include check, ACH bank transfer, and major credit cards. Financing options may be available through our third-party financing partner.
- Accounts that are past due may be subject to a finance charge and collection costs, including reasonable attorney’s fees, as permitted by Tennessee law.
5. Warranties
Pier Systems (Helical and Push Piers): Ground Up Foundation Repair provides a lifetime transferable warranty on helical pier and push pier installations. This warranty covers the structural performance of the installed pier system and transfers to subsequent owners of the property upon sale. Warranty documentation is provided at project close.
Other Repairs: Warranty terms for wall anchors, carbon fiber straps, crack injection, concrete leveling, crawl space repairs, and other services are set forth in the applicable service agreement. Consult your project documents for specific terms.
Warranty Exclusions: Warranties do not cover damage caused by events beyond our control, including but not limited to acts of God, flood, earthquake, drainage changes made after the repair, modifications to the repair made by others, or failure of adjacent structures or utilities not included in the scope of work.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Ground Up Foundation Repair’s total liability for any claim arising out of or related to our services shall not exceed the total amount paid by you for the specific work giving rise to the claim. We shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of use, loss of revenue, or diminution in property value.
7. Property Access and Conditions
You grant us the right to access your property to perform the agreed work. You are responsible for ensuring that access is available on scheduled work dates and that any pets, vehicles, or other obstructions are cleared from the work areas. We will make reasonable efforts to protect your property during work and to restore disturbed areas upon completion.
You represent that you have the authority to authorize the work described in the service agreement, either as the property owner or as an authorized agent of the property owner.
8. Changes, Cancellations, and Rescheduling
You may cancel or reschedule a scheduled service by contacting us at least 48 hours before the scheduled start date. Cancellations made after materials have been ordered or fabricated for your project may be subject to a restocking or cancellation fee, which will be specified in your service agreement.
9. Website Use
Our website is provided for informational purposes. You agree not to use the site for any unlawful purpose or in any way that could damage, disable, or impair the site. All content on this website, including text, images, logos, and copy, is the property of Ground Up Foundation Repair or its licensors and may not be reproduced without written permission.
10. Governing Law and Dispute Resolution
These Terms and any dispute arising out of your use of our website or our services shall be governed by the laws of the State of Tennessee, without regard to its conflict of laws principles. Any legal action shall be brought in the courts of Rutherford County, Tennessee, and you consent to personal jurisdiction in that venue.
You agree to notify us in writing of any dispute and allow us 30 days to attempt resolution before initiating any legal proceeding.
11. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with a revised effective date. Continued use of our website or engagement of our services after changes are posted constitutes acceptance of the revised Terms.
